By creating an account or using the Aleph Safe platform, you agree to be bound by these Terms of Service. Please read them carefully before using the platform. If you do not agree to these terms, you may not use Aleph Safe.
1. Definitions
In these Terms of Service, the following definitions apply:
- "Platform" means the Aleph Safe web application and all associated services available at alephsafe.co.za
- "User" means any individual or entity that creates an account on or uses the Platform
- "Generated Documents" means safety files, risk assessments, method statements, legal appointments, and any other documents produced using the Platform's AI tools
- "Subscription" means a paid or free plan that grants the User access to specified Platform features
- "Content" means any information, data, text, or files submitted by the User to the Platform
- "We", "Us", "Our" means Aleph Safe (Pty) Ltd
2. Acceptance of Terms
By registering an account, accessing, or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you are using the Platform on behalf of a company or organisation, you represent that you have the authority to bind that entity to these terms.
We reserve the right to update these Terms of Service at any time. We will notify registered users of material changes by email. Your continued use of the Platform after any changes constitutes acceptance of the updated terms.
3. Account Registration
To access the Platform you must create an account by providing accurate and complete information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorised use of your account at support@alephsafe.co.za
- Ensuring that all information you provide remains accurate and up to date
We reserve the right to suspend or terminate accounts that provide false information, violate these terms, or engage in fraudulent activity.
4. Subscription Plans and Billing
Aleph Safe offers both free and paid subscription plans. Paid subscriptions are billed monthly or annually as selected at the time of purchase.
- Free plan: Limited to 3 document generations and 1 project. No credit card required.
- Paid plans: Charged in South African Rand (ZAR) at the rates published on our pricing page. Prices are inclusive of VAT where applicable.
- Annual billing: Annual subscriptions are billed upfront for the full year and offer a discount compared to monthly billing.
- Renewals: Subscriptions renew automatically unless cancelled before the renewal date.
- Price changes: We will provide at least 30 days notice before changing subscription prices. Continued use after the effective date constitutes acceptance of new pricing.
All payments are processed by a third-party payment provider. We do not store your payment card details on our servers.
5. Cancellation and Refunds
You may cancel your subscription at any time from your account settings. Upon cancellation:
- Your subscription will remain active until the end of the current billing period
- You will not be charged for subsequent billing periods
- No refunds are provided for partial months or unused portions of an annual subscription, except where required by applicable South African consumer protection legislation
- Your generated documents and project data will remain accessible for 30 days after cancellation, after which they may be deleted
If you believe you have been charged in error, contact us at billing@alephsafe.co.za within 30 days of the charge.
6. Use of AI-Generated Documents
This section is critical. Please read it carefully.
Aleph Safe uses artificial intelligence to generate safety documents. You acknowledge and agree that:
- Review obligation: All Generated Documents must be reviewed and approved by a competent person as defined under the OHS Act 85 of 1993 or Mine Health and Safety Act 29 of 1996 before being used on any site or submitted to any regulatory authority
- No legal advice: Generated Documents do not constitute legal advice. Aleph Safe is a technology platform, not a registered health and safety practitioner or legal advisor
- Accuracy: While our AI is trained on real South African safety documents, we do not guarantee that any Generated Document is legally sufficient for any specific site, activity, or regulatory requirement
- Legislative changes: You are responsible for ensuring that Generated Documents remain compliant with any legislative amendments that may occur after the document was generated
- Professional responsibility: The legal and professional responsibility for the accuracy, appropriateness, and implementation of any safety document rests with the User and the appointed competent person — not with Aleph Safe
- Customisation: Generated Documents are starting points that should be customised to reflect the actual conditions, risks, and controls specific to your site and operations
7. Intellectual Property
The Platform, including its design, code, AI models, document templates, and training data, is the intellectual property of Aleph Safe (Pty) Ltd and is protected by applicable South African and international intellectual property law.
Generated Documents produced using the Platform are owned by the User who generated them. By generating documents, you grant Aleph Safe a limited, non-exclusive licence to store and display those documents within the Platform for the purpose of providing the service.
You may not copy, reverse engineer, decompile, or attempt to extract the source code of the Platform or its AI models.
8. User Content and Conduct
You retain ownership of all Content you submit to the Platform. By submitting Content, you grant Aleph Safe a limited licence to process that Content solely for the purpose of providing the service to you.
You agree not to use the Platform to:
- Submit false, misleading, or fraudulent information
- Generate documents for sites or activities you are not authorised to represent
- Attempt to circumvent any security measures or usage limits
- Use the Platform in any way that violates applicable South African law
- Resell or sublicense access to the Platform without written authorisation from Aleph Safe
- Scrape, crawl, or systematically extract data from the Platform
9. Limitation of Liability
To the maximum extent permitted by applicable South African law, Aleph Safe and its directors, employees, and agents shall not be liable for:
- Any loss or damage arising from your use or inability to use the Platform
- Any reliance on Generated Documents without independent professional review
- Any regulatory penalty, site shutdown, or legal proceeding arising from the use of Generated Documents
- Any indirect, incidental, special, or consequential damages
- Any loss of data, revenue, or business opportunity
Our total liability to you for any claim arising from your use of the Platform shall not exceed the total subscription fees paid by you in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless Aleph Safe (Pty) Ltd, its directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, your violation of these terms, or your use of Generated Documents without appropriate professional review.
11. Service Availability
We aim to provide a reliable platform but do not guarantee uninterrupted availability. We may perform maintenance, updates, or modifications that temporarily affect access. We will endeavour to provide advance notice of planned downtime where possible. Aleph Safe shall not be liable for any loss arising from temporary unavailability of the Platform.
12. Termination
We reserve the right to suspend or terminate your account without notice if you violate these Terms of Service, engage in fraudulent activity, or if we are required to do so by law. Upon termination, your right to access the Platform ceases immediately. Sections 6, 7, 9, and 10 of these terms survive termination.
13. Governing Law and Disputes
These Terms of Service are governed by the laws of the Republic of South Africa. Any dispute arising from these terms or your use of the Platform shall be subject to the exclusive jurisdiction of the South African courts. We encourage you to contact us first at legal@alephsafe.co.za to resolve any dispute informally before initiating formal proceedings.
